crsc/cdrp and etc info
Greetings, when a vet had a va disability and was at least a 20 year retiree he gave up his retired pay to draw va comp if the va comp was more than retired pay it was smart to do that--plus va comp is non-taxable but retired pay is taxable. Then congress decided that this was unfair to make a disabled vet lose his 20 year investment--so as a token congress sAYS IF YOU ARE AT LEAST 50% DISABLED BY A COMBAT RELATED INCIDENT then based on an award of VA disability you can now apply for combat related special compensation which is paid at the percentage of crsc awarded by the army, navy,marines, airforce,coast guard and will be as much as your retired pay not more or a percentage of it. you must apply for crsc to the service concerned for approval. If your already on disability for an injury not qualifying for crsc then you will be enrolled eff 1 jan 2004 if your 50% disabled or any percentage from 10% up if your injury awarded you the purple heart. you need not make an application to draw crdp which is effective 1 jan 2004. usually upon initial award of va comp va deducted the amount of retired pay you were receiving during the time it took to process your application--the va award letter tells you what was deducted and for what period. now if you apply for crsc and are approved retro and that retro period encompasses the period that va withheld the retired pay--the award of crsc for that very period voids the va deduction and now that money is due you--i fought va and dfas for over 2 years till i was able to prove they owed me and now its to be paid to about 100,000 vets to the tune of about 500 million. but of course you must have an award by va to even qualify for crsc and when you apply you need evidence your combat related injury was combat related. Exposure to Agent Orange has several medical problems that are automatically presumed to be combat related by reason of your vietnam service. the list is on the va website. after i was awarded va comp i applied for crsc and it was awarded covering that period that va had withheld my retired pay--so im now receiving full va comp and full retired pay and they are in the process of paying that money va withheld for the period which took time to process my application--va and dfas are now working out a stop gap measure to prevent this from happening to future vets in my same or similiar circumstances--I hope this will help you and your dad. regards dan
