Do I lose out - CRDP

    Received a letter from the VA in Feb 2005, stating that a special review of my file increased my service-connected disability to 60% with an effective date of Nov 2003. Reason for the increase is as follows, "Rating decision is clearly and unmistakable erroneous because it failed to consider and assign a separate evaluation for radiculopathy C5-6. An evaluation of 20 percent is assigned for radiculopathy C5-6, effective Nov 2003." I retired with 21 years of service. Question is: Due to the error, am I authorized backpay for the year 2004? I called DFAS and was told that they start payment when VA notifies them (started receiving CRDP effective Feb 2005, no backpay). Does VA have a notification system to DFAS in place when mistakes are made? Or Do I Lose Out?

    DFAS will only pay CRDP from the time VA first notifies them. There is no provision for "back pay".
